Chères et chers compatriotes,
La République n’a pas DEUX (2) CONSTITUTIONS: celle de 1987 et celle de 1987 amendée. Elle a une (1) seule Constitution: 1987 amendée ou 1er amendement. Nous attendons le prochain arrêté de l’Exécutif pour savoir si nous aurons une Assemblée Constituante pour une Nouvelle Constitution ou bien une Commission de Révision constitutionnelle pour un Deuxième Amendement de la Constitution 1987 amendée. Partant de cet éclaircissement, je souligne à votre attention une ambiguïté dans l’article 1.1 de notre Constitution: le siège du gouvernement et celui de la présidence. D’après l’article 133 de la Charte de la République, « Le Pouvoir Exécutif est exercé par:
1.- Le Président de la République, chef de l’État;
2.- Le gouvernement ayant à sa tête un Premier Ministre ».
Il s’agit d’un Exécutif à deux (2) têtes ou bicéphale. En d’autres termes, le siège de la présidence est différent de celui du gouvernement. Et alors, l’adresse de ce dernier est-elle à la capitale ou dans la Commune de Delmas?
Peut-on utiliser encore Port-au-Prince comme siège de la Présidence et siège du Gouvernement?
En effet, Port-au-Prince, la capitale de la République, se trouve confrontée à une guérilla, une rébellion de bandits, de kidnappeurs et de vandales. Les rebelles occupent plus de 50% du territoire de la capitale. Le gouvernement démissionnaire ne contrôle que le Palais National à 100%. La Primature n’est plus au Boulevard Harry Truman situé à la place du Bicentenaire.
Sous le gouvernement du Premier Ministre Joseph Jouthe, avant l’assassinat du President Jovenel Moïse, elle a été transférée, en raison de l’insécurité, à Delmas 60.

Ne serait-il pas mieux de déplacer le siège de la présidence et celui du gouvernement dans une autre Ville du pays si la Mission Multinationale de Soutien à la Sécurité n’arrive pas avant l’installation du Conseil Présidentiel de Transition?
La question est ouverte.
